User Agreement

Welcome to use tkesj services!

tkesj(hereinafter referred to as "we") provide users (hereinafter referred to as "you") withtkesjServices. This Agreement is legally binding on both you and us.

1. Functions of this service

1.1 Customer acquisition data collection and analysis system, this tool provides customer source analysis and collection.
1.2 To use this service, you need to download and install the tkesj client software that matches your terminal device. You may only use these software and services for the purpose of accessing or using this service.
1.3 All other rights not expressly authorized in this clause and other clauses of this Agreement are reserved by tkesj. You must obtain tkesj's written permission when exercising these rights. If tkesj does not exercise any of the aforementioned rights, it does not constitute a waiver of such rights.

2. Software Acquisition

2.1 You can obtain this software directly from tkesj's website through customer service, or you can obtain it from a third party authorized by tkesj.
2.2 If you obtain this software or software of the same name through an unauthorized third party, tkesj does not guarantee that the software can be used normally and will not be responsible for any losses caused to you.
2.3 tkesj has developed different software versions for different terminal devices. You should choose to download the appropriate version for installation according to the actual situation.

III. Software Update

3.1 In order to improve user experience and improve service content, tkesj will continue to work hard to develop new services and provide you with software updates from time to time (these updates may take the form of software replacement, modification, function enhancement, version upgrade, etc.).
3.2 In order to ensure the security and functional consistency of this software and service, tkesj has the right to update the software without special notice to you, or change or limit some of the functional effects of the software.
3.3 After the new version of this software is released, the old version of the software may not be available. tkesj does not guarantee that the old version of the software will continue to be available and provide corresponding customer service. Please check and download the latest version at any time.

IV. User Personal Information Protection

4.1 tkesj will use various security technologies and procedures to establish a sound management system to protect your personal information to avoid unauthorized access and use. Except for the circumstances stipulated by laws and regulations, tkesj will not disclose your personal information to any company, organization or individual other than tkesj. tkesj uses professional encryption storage and transmission methods to ensure the security of user personal information.
4.2 During the use of this service, the tkesj client will ask you as needed and obtain some necessary information with your permission, for example: when retrieving your password or performing user identity identification, you need to fill in your mobile phone number; when sending location information, you need to agree to use your geographical location information. If you do not allow the tkesj client to obtain such necessary information, you will not be able to use the corresponding service or will be restricted during use.

V. User Notes

5.1 Before using this service, you need the enterprise administrator to register and assign you an tkesj account. Users are responsible for properly keeping account information and ensuring the security of account passwords, and users need to bear legal responsibility for the actions under their accounts and passwords.
5.2 You understand and agree that in order to provide you with effective services, this software will use resources such as the processor and bandwidth of your terminal device. Data traffic fees may be incurred during the use of this software. Users need to obtain relevant tariff information from the operator and bear the relevant fees.
5.3 When you use a specific service of this software, the service may have a separate agreement, relevant business rules, etc. (hereinafter collectively referred to as "Separate Agreement"). Please read and agree to the relevant separate agreement before using this service.
5.4 You understand and agree that tkesj will make its commercially reasonable efforts to ensure the security of your data storage in this software and service, but tkesj cannot provide complete guarantee in this regard, including but not limited to the following situations:
5.4.1 tkesj is not responsible for the deletion or storage failure of your relevant data in this software and service;
5.4.2 tkesj has the right to determine the maximum storage period of a single user's data in this software and service according to actual conditions, and allocate the maximum data storage space for it on the server. You can back up the relevant data in this software and service according to your own needs;
5.4.3 If you stop using this software and service or the service is terminated or cancelled, tkesj can permanently delete your data from the server. After the service is stopped, terminated or cancelled, tkesj has no obligation to return any data to you.
5.4.4 When using this software and services, users must bear the following risks that tkesj cannot control, including but not limited to:
5.4.4.1 Risks such as loss and leakage of personal information due to force majeure;
5.4.4.2 Users must choose the software version that matches the installed terminal device, otherwise, any problems or damages caused by the mismatch between the software and the terminal device model shall be borne by the user;
5.4.4.3 When users use this software to visit third-party websites, the risks caused by third-party websites and related content shall be borne by the user;
5.4.4.4 Risks such as failure to log in to the tkesj client, incomplete data synchronization, slow page opening speed, etc. due to unstable wireless network signals, small wireless network bandwidth, etc.
5.5 Third-party products and services
5.5.1 When you use products or services provided by third parties of this software, in addition to complying with the provisions of this agreement, you should also comply with the user agreement of the third party. tkesj and the third party shall each bear their own responsibilities for any disputes that may arise within the scope of legal provisions and agreements.
5.5.2 When users use this software or require tkesj to provide specific services, this software may call a third-party system or support the user's use or access through a third party. The results of the use or access are provided by the third party. tkesj does not guarantee the security, accuracy, effectiveness and other uncertain risks of the services and content provided by the third party. Any disputes and damages caused by this have nothing to do with tkesj, and tkesj does not bear any responsibility.

VI. User Specifications

6.1 Information Content Specifications
6.1.1 The information content described in this article refers to any content produced, copied, published, and disseminated by users during the use of this software and services, including but not limited to avatars, text, voice, pictures, and related links.
6.1.2 You understand and agree that you may not use this software and services to produce, copy, publish, or disseminate the following content that interferes with the normal operation of tkesj and infringes on the legitimate rights and interests of other users or third parties, including but not limited to:
6.1.2.1 Publishing, transmitting, disseminating, and storing content prohibited by national laws and regulations:
(1) Violating the basic principles established by the Constitution;
(2) Endangering national security, leaking state secrets, subverting the state power, and undermining national unity;
(3) Damaging national honor and interests;
(4) Inciting ethnic hatred and discrimination, and undermining national unity;
(5) Undermining national religious policies, promoting cults and feudal superstitions;
(6) Spreading rumors, disrupting social order, and undermining social stability;
(7) Spreading obscenity, pornography, gambling, violence, etc. , terrorism or abetment of crime;
(8) insulting or defaming others, infringing upon the legitimate rights and interests of others;
(9) inciting illegal assembly, association, procession, demonstration, gathering to disturb social order;
(10) carrying out activities in the name of illegal non-governmental organizations;
(11) not complying with the "Interim Provisions on the Development and Management of Public Information Services of Instant Messaging Tools" and the "seven bottom lines" of abiding by laws and regulations, the socialist system, national interests, the legitimate interests of citizens, public order, social morality and authenticity of information;
(12) containing other content prohibited by laws and administrative regulations.
6.1.2.2 Publish, transmit, disseminate, and store content that infringes upon others’ reputation, portrait rights, intellectual property rights, trade secrets, and other legal rights;
6.1.2.3 Involve others’ privacy, personal information, or data;
6.1.2.4 Publish, transmit, disseminate harassment, advertising information, and spam information or any sexual or sexual suggestion;
6.1.2.5 Other information that violates laws, regulations, policies, public order and good customs, social morality, or interferes with the normal operation of tkesj and infringes upon the legal rights and interests of other users or third parties.
6.2 Usage Guidelines
Unless permitted by law or with written permission from tkesj, you may not engage in the following actions while using this software:
6.2.1 Delete copyright information on this software and its copies;
6.2.2 Reverse engineer, reverse assemble, reverse compile this software, or otherwise attempt to discover the source code of this software;
6.2.3 Use, rent, lend, copy, modify, link, reprint, compile, publish, establish mirror sites, etc. for content to which tkesj has intellectual property rights;
6.2.4 Copy, modify, add, delete, mount, or create any derivative works of this software or data released to any terminal memory during the operation of this software, interactive data between the client and the server during the operation of the software, and system data required for the operation of this software, including but not limited to the use of plug-ins, external plug-ins, or third-party tools/services not authorized by tkesj to access this software and related systems;
6.2.5 By modifying or forging the instructions and data in the software operation, adding, deleting, changing the functions or operating effects of the software, or operating or disseminating the software and methods used for the above purposes to the public, whether or not these actions are for commercial purposes;
6.2.6 Log in or use tkesj software and services through third-party software, plug-ins, external plug-ins, systems that are not developed or authorized by tkesj, or produce, publish, and disseminate the above tools;
6.2.7 Interfere with this software and its components, modules, and data by yourself or authorize others or third-party software;
6.2.8 Other actions not expressly authorized by tkesj.
6.3 Behavior Responsibility
You fully understand and agree that you must be responsible for all actions under your account, including any content you publish and any consequences arising therefrom. You should judge the content in this service on your own and bear all risks caused by the use of the content, including the risks caused by reliance on the correctness, completeness or practicality of the content. tkesj cannot and will not be responsible for any loss or damage caused by the aforementioned risks.
6.4 Breach of Contract
6.4.1 If tkesj discovers or receives reports or complaints from others that a user has violated the provisions of this Agreement, tkesj has the right to delete or block the relevant content at any time without notice.
6.4.2 You understand and agree that tkesj has the right to take appropriate legal actions against any user who violates the law and regulations based on reasonable judgment, and to save relevant information and report to relevant departments in accordance with laws and regulations. Users shall bear all legal responsibilities arising therefrom.
6.4.3 You understand and agree that you shall be solely responsible for any claims, demands or losses claimed by a third party caused or generated by your violation of the provisions of this Agreement or related service terms; if tkesj suffers losses as a result, you shall also compensate for them.

VII. Intellectual Property

7.1 tkesj is the intellectual property rights holder of this software. All copyrights, trademarks, patents, trade secrets and other intellectual property rights of this software, as well as all information content related to this software (including but not limited to text, pictures, audio, video, charts, interface design, layout framework, relevant data or electronic documents, etc.) are protected by the laws and regulations of the People's Republic of China and relevant international treaties, and tkesj enjoys the above intellectual property rights.
7.2 Without the written consent of tkesj or the relevant right holder, you shall not implement, use or transfer the above intellectual property rights by yourself or authorize any third party to implement, use or transfer the above intellectual property rights for any commercial or non-commercial purpose.

VIII. Terminal Security Responsibility

8.1 You understand and agree that other software downloaded and installed by users or other websites visited by users may contain viruses, Trojans or other malicious programs, which may threaten the information and data security of your terminal equipment and then affect the normal use of this software.
8.2 tkesj will reasonably and prudently take necessary technical measures in accordance with industry standards to protect the information and data security of your terminal equipment, but you acknowledge and agree that tkesj cannot provide complete guarantees in this regard.

IX. Third-party software or technology

9.1 This software may use third-party software or technology (including open source code and public domain code that may be used by this software, etc., the same below), and such use has been legally authorized.
9.2 Any disputes caused by third-party software or technology used in this software shall be resolved by the third party, and tkesj shall not bear any responsibility. tkesj does not provide customer service support for third-party software or technology. If you need support, please contact the third party.

X. Agreement signing

10.1 The titles of all clauses in this agreement are for reading convenience only and have no actual meaning in themselves. They cannot be used as the basis for interpreting the meaning of this agreement.
10.2 Regardless of the reason why some of the clauses of this agreement are invalid or unenforceable, the remaining clauses remain valid and binding on both parties.
